1. Acceptance of These Terms

By accessing unclutterphotos.com, creating an account, downloading, installing, purchasing, activating, or using UnclutterPhotos, you agree to these Terms of Use. If you do not agree, do not use the services or software.

2. Products Covered

These Terms apply to:

• UnclutterPhotos web app: browser-based photo duplicate and organization tools.
• UnclutterPhotos Desktop: the Windows desktop photo management application.
• Related services: accounts, trials, license keys, downloads, updates, support, email delivery, and payment/order processing.

3. Local Photo Processing and User Responsibility

UnclutterPhotos is designed around local-first photo processing. Photo scanning, hashing, duplicate review, thumbnail generation, metadata reading, organization, and editing generally happen on your device. Original photo files are not uploaded to our servers for core processing.

You are responsible for:

• Choosing which files or folders the app may access.
• Reviewing duplicate suggestions before deleting files.
• Maintaining backups of important photos and files.
• Understanding that file deletion, renaming, organization, or editing actions may affect files on your device.

We strongly recommend backing up your photos before using deletion, renaming, or organization features. Duplicate deletion may be permanent and may not be recoverable by UnclutterPhotos.

4. Photo Metadata, Local Storage, and Internet-Connected Features

The desktop application may store local app data on your computer, including indexed folder paths, thumbnails, EXIF/photo metadata, ratings, tags, albums, cache files, local database records, app settings, and license/session state.

Certain features require internet access, including account sign-in, license activation, license validation, update checks, map tiles, and reverse geocoding. Map and location features may use GPS coordinates from photo metadata to show locations or request location names from external services.

5. Accounts and Security

You may need an account to use saved web features, start a desktop trial, activate a license, recover license keys, or access paid functionality. You agree to provide accurate account information and keep your credentials secure. You are responsible for activity that occurs through your account.

6. Trials, Licenses, and Device Limits

UnclutterPhotos Desktop may offer a free trial with limits, such as time, indexed photo count, device count, or locked photo tools. Paid licenses may be limited by plan duration, number of devices, feature access, and account ownership.

License keys are for your own use under the plan you purchased. You may not share, sell, publish, bypass, tamper with, reverse engineer, or attempt to defeat the licensing system. We may suspend or revoke licenses involved in abuse, fraud, chargebacks, unauthorized sharing, or violation of these Terms.

7. Payments, Pricing, Taxes, and Refunds

Prices, plans, trial limits, and features may change over time. Payments may be processed by third-party payment providers or marketplace platforms, including but not limited to Microsoft, Lemon Squeezy, Paddle, Buy Me a Coffee, or other providers we choose to support.

Payment providers may handle taxes, invoices, billing details, refunds, chargebacks, and payment compliance according to their own terms and policies.

Unless a specific refund policy is stated at checkout or required by applicable law or marketplace rules, license purchases are generally non-refundable after a license key has been issued, emailed, activated, or used. If you believe a purchase was made in error or the software cannot function as described on your device, contact us at support@unclutterphotos.com and we will review the request in good faith.

Purchases made through Microsoft Store or another marketplace are subject to that marketplace’s refund and billing rules. In those cases, refund requests may need to be handled through the marketplace.

8. Updates and Changes to the Software

We may release updates, bug fixes, security improvements, feature changes, or compatibility changes. The desktop app may check for available updates and direct you to download a newer version. We may modify, add, or remove features over time.

9. Acceptable Use

You agree not to:

• Use UnclutterPhotos for unlawful, harmful, abusive, or fraudulent purposes.
• Attempt to bypass license checks, trial limits, device limits, security controls, or access restrictions.
• Reverse engineer, decompile, modify, redistribute, resell, or create derivative works from the software except where allowed by law.
• Interfere with our servers, APIs, downloads, licensing systems, or other users.
• Upload, send, or share content with us that you do not have the right to share.

10. Third-Party Services and Distribution Channels

UnclutterPhotos may use or integrate with third-party services such as Supabase, Resend, Cloudflare, payment providers, map/location services, Microsoft Store, and operating-system services. Your use of those services may be subject to their own terms and privacy policies.

If you obtain UnclutterPhotos through Microsoft Store or another marketplace, the marketplace may apply additional license, distribution, billing, update, refund, and account terms.

11. Intellectual Property

UnclutterPhotos, including the website, desktop software, user interface, branding, code, documentation, and related materials, is owned by UnclutterPhotos or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the software and services according to your plan and these Terms.

12. Disclaimers

UnclutterPhotos is provided on an “as is” and “as available” basis. We do not guarantee that duplicate detection, metadata extraction, file organization, editing, map display, RAW preview generation, or any other feature will be error-free, complete, uninterrupted, or suitable for every photo library or device.

You remain responsible for reviewing results and maintaining backups before making file changes.

13. Limitation of Liability

To the maximum extent permitted by law, UnclutterPhotos will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of photos, files, metadata, profits, revenue, goodwill, data, or business opportunity arising from your use of or inability to use the software or services.

To the maximum extent permitted by law, our total liability for any claim related to the software or services will not exceed the amount you paid to UnclutterPhotos for the relevant license or service in the twelve months before the claim.

14. Termination

You may stop using UnclutterPhotos at any time. We may suspend or terminate access to accounts, trials, licenses, downloads, or services if we believe you violated these Terms, created risk, engaged in fraud or abuse, or if required by law. Termination does not automatically delete local data stored on your device.

15. Privacy

Our collection and use of information is described in our Privacy Policy. The Privacy Policy explains account data, IP/download information, desktop telemetry, photo metadata handling, local storage, and third-party service providers in more detail.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and post the revised Terms on this page. Continued use of UnclutterPhotos after changes become effective means you accept the updated Terms.

17. Governing Law

These Terms will be governed by applicable laws, without regard to conflict-of-law principles, except where consumer protection laws in your location require otherwise.
